End User License Agreement

This End User License Agreement (“EULA”) is a binding agreement between you and the developer of Critical Care Daily (“we,” “us”) governing your use of the Critical Care Daily mobile application (the “Licensed Application”).

1. License grant

We grant you a limited, non-transferable, non-exclusive, revocable license to use the Licensed Application on any Apple-branded product that you own or control, subject to the Usage Rules in the Apple Media Services Terms and Conditions. The license does not permit you to use the Licensed Application on a device you do not own or control, and you may not distribute or make it available over a network where it could be used by multiple devices at once.

2. Restrictions

You may not copy (except as expressly permitted by this license), decompile, reverse-engineer, disassemble, attempt to derive the source code of, modify, or create derivative works of the Licensed Application, any updates, or any part thereof. You may not rent, lease, lend, sell, redistribute, or sublicense the Licensed Application.

3. Consent to use of data

You agree that we may collect and use technical data and related information — including but not limited to information about your device, system, and application software — that is gathered periodically to facilitate updates, product support, and other services. We may use this information solely to improve the Licensed Application and as described in the privacy policy.

4. Termination

This license is effective until terminated by you or by us. Your rights under this license will terminate automatically without notice if you fail to comply with any term(s). Upon termination, you must cease all use of the Licensed Application and destroy all copies, full or partial.

5. External services

The Licensed Application may enable access to third-party services and websites (collectively, “External Services”). You agree to use External Services at your sole risk. We are not responsible for examining or evaluating the content or accuracy of any External Services, and we are not liable for them.

6. No warranty

You expressly acknowledge and agree that use of the Licensed Application is at your sole risk. The Licensed Application is provided “AS IS” and “AS AVAILABLE,” with all faults and without warranty of any kind. To the maximum extent permitted by applicable law, we disclaim all warranties, express or implied, including the implied warranties of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment, and non-infringement.

Not medical advice. Critical Care Daily is an educational resource for trained clinicians. Content does not constitute medical advice, diagnosis, or treatment for any individual patient and must not be used to make patient-care decisions. Always exercise independent clinical judgment and follow your institution's protocols and applicable standards of care.

7. Limitation of liability

To the extent not prohibited by law, in no event shall we be liable for personal injury or any incidental, special, indirect, or consequential damages whatsoever, including damages for loss of profits, loss of data, business interruption, or any other commercial damages or losses, arising out of or related to your use of or inability to use the Licensed Application.

8. Maintenance and support

We — not Apple — are solely responsible for providing any maintenance and support services for the Licensed Application, as specified in this EULA or as required under applicable law. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.

9. Intellectual property

In the event of any third-party claim that the Licensed Application or your possession and use of it infringes that third party's intellectual property rights, we — not Apple — will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.

10. Apple as third-party beneficiary

You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third-party beneficiary.
